Miami Beach United supports the position taken by South of Fifth Neighborhood Association (2.7.17 email),
Sunset Harbour Neighborhood Association, West Avenue Neighborhood Association, condominium
associations South of Fifth Street and other neighborhood groups that the City should vigorously enforce any
quality of life ordinances relating to entertainment and noise producing activities in residential areas.

Furthermore, MBU believes that the agreement with the representatives from Bakehouse, allowing them to have
a saxophone player during limited days and hours -- which is a violation of an existing South of Fifth ordinance --
sets a dangerous precedent. This could lead to more violations by developers and operators of commercial
businesses, under the belief that by threatening a lawsuit, the City will permit otherwise unlawful activities. In fact,
we understand that the special exemption afforded to Bakehouse has already been breached, which is further
evidence that accommodation only encourages more illegal activity.

If the Commission believes a currently prohibited activity, should be allowed, then it should seek to amend the
ordinance through the public process that currently exists.

This was a major victory for residents of Miami Beach, whose quality of life would have been significantly
adversely impacted by this ill-conceived project. Happily, through many efforts including those of Mark Samuelian
(see his remarks, spoken on his own behalf, at 3:30) and Michael Barrineau (see his remarks, representing
MBU, following shortly after at the video link below), the City of Miami Commission declared Flagstone Island
Gardens in default of city contract and the project in its current form is now dead, once and for all.

“This is a changing tide in the city of Miami that’s in favor of transparency and accountability. Fifteen years this
project hasn’t gotten off the ground,” said Commissioner Ken Russell, who called for Tuesday’s special meeting
on the grounds that the developer had missed a May 1 deadline to begin construction. “This will be the end of it”

The Miami Commission today took a bold step in repairing the culture of governance in the City of Miami.
By a 5-0 vote the Commissioners voted in favor of a Resolution put forth by Commissioner Ken Russell along
with a supporting amendment by Commissioner Francis Suarez to declare the Flagstone Watson Island Project
in default.

Commissioners Frank Carollo and Willie Gort spoke eloquently of the history and reasons behind their vote to
bring the project to an end.

This action means that automatically the project is terminated and all facilities go back to the City. Permitting a
court to rule, in the event Flagstone sues, will give the public the opportunity to reveal a pattern of senior official
wrongdoing including violating the City Charter, misleading Commissioners, accepting applications that were
knowingly false and other absurdities that have marked the sad history of this project.
